The Consultation Document released
in September last year has several proposals failed to incorporate into the
National Security (Legislative Provisions) Bill, including the following: -
(a)
"Non-violent
threats" (e.g. electronic sabotage) in the offence of treason; and
(b)
The
extra-territorial effect on all persons in respect of their actions outside the
HKSAR, if such actions have a "link" with the HKSAR set out in the
Criminal Jurisdiction Ordinance
in the offences of secession and subversion.
Despite that, the Government gave
notice to move a motion at the Legislative Council meeting of 18 December 2002
to approve the Criminal Jurisdiction Ordinance (Amendment of Section 2(2))
Order 2002, which may partially implement the above proposals. The LegCo has
formed a Subcommittee to study the Order and ask the Government to identify the
parts of National Security (Legislative Provisions) Bill that are related to
the Order.
